FDA Badge1) When President Obama signed the “Family Smoking Prevention and Tobacco Control Act” last summer, many viewed the FDA’s newfound authority over tobacco as a cigarette issue. The law, after all, doesn’t automatically apply to cigars (as it does to cigarettes and smokeless tobacco). Instead, it requires the bureaucracy to issue a specific regulation bringing cigars under its purview. This week the FDA signaled its intention to do so in June. If the proposed rule is adopted, cigar makers, retailers, and consumers worry the government will tightly restrict cigar marketing and events, as well as require cigar “ingredient disclosure”—a move that would cost manufacturers huge sums of money in testing and documentation and likely restrict innovation.

2) Politicians in Mobile, Alabama, are considering a law that would be a new frontier for anti-smoking zealotry. The proposed legislation would empower health inspectors to deduct points from businesses that allow smoking, even though there is no scientific basis for the punitive measure. As Chris McCalla of the IPCPR points out, “The fact is that OSHA [Occupational Safety and Health Administration] has set safe levels for smoking that are up to 25,000 times higher than normally found in an average bar or restaurant that allows smoking.”

3) Inside the Industry: Scandinavian Tobacco and Swedish Match will merge their cigar operations later this year, bringing CAO, General Cigar, and retailer Cigars International under one roof. In an effort to lower its prices, United Tobacco—maker of 601, Cubao, and Murcielago—is parting ways with distributor Miami Cigar & Company. Meanwhile, in celebration of Miami Cigar & Company’s founding in 1989, the Nestor Miranda Collection is adding a new blend in three sizes: “1989” will be a Nicaraguan puro made by Don Pepin Garcia that will sell for just $5.

Alejandro Robaina1) Tobacco giant Alejandro Robaina, a “roving ambassador for Cuban cigars” for the last two decades, passed away at the age of 91. His long battle with cancer ended at his home in San Luis on Saturday. Robaina will be remembered as Cuba’s foremost producer of top wrapper leaves and for being the voice of small tobacco growers in Pinar del Río. He refused Castro’s request to join a government cooperative and, choosing to remain family-owned and independent, he consistently outperformed state-owned tobacco plantations. Castro apparently didn’t take Robaina’s refusal personally, awarding him the honor of top Cuban tobacco grower in the mid-90s and launching a brand in his name. “Vegas Robaina,” as it is called, likely doesn’t include any tobacco from Robaina’s farm.

2) Inside the Industry: The highly-anticipated Nosotros cigar – a joint project of Illusione’ Cigars and Drew Estate’ is finally being released. Cuba’s annual limited edition smokes are beginning to ship, including a Montecristo Grand Edmundo, Partagas Serie D Especial and a Trinidad Short Robusto. Punch Cigars is teaming up with grill company Char-Broil to promote cigars and grilling, including recipes to pair with Punch’s many cigar blends. La Aurora is promoting its new La Aurora 107 blend by giving away free cigars (while supplies last) at certified retailers on Friday, April 30th.

Taxed!1) Cigar taxes, already excessive at the federal level because of SCHIP, are being increased in two western states. Utah passed a hike that skyrockets cigar taxes from 35% of the manufacturer’s sale price to 86%—among the highest in the country. A 51% inventory tax for tobacco retailers was also included in the legislation. Meanwhile, in Washington, state politicians boosted the cigar tax cap from 50 cents to 65 cents per stogie. “The only consolation in this tax increase,” according to a press release from the International Premium Cigar & Pipe Retailers Association, “is the fact that no floor stocks provision was included in the approved legislation.”

2) Noteworthy Events: The Texas Cigar Festival will be held on April 24 and feature the likes of Eddie Ortega, Tim Ozgener, Rocky Patel, Pete Johnson, Litto Gomez, Sam Leccia, Don Pepin Garcia, and many others. Cigar Connection, a B&M in Northern Virginia, will host J. Fuego on April 30. The Tennessee Cigar & Brew Fest has been announced for October.

3) Inside the Industry: There’s been online speculation that, with the introduction of the Ambos Mundos line, Tatuaje would be discontinuing its Series P blend—a medium-filler cigar made with the same tobacco as the Havana VI line.  When asked, Tatuaje creator Pete Johnson told StogieGuys.com this week: “Haven’t made it in a long time. Just using older inventory. Still not sure what I am going to do with the line.”

Cigar Rights of America1) Cigar Rights of America, a consumer public advocacy group that works to protect the freedoms of cigar enthusiasts, has launched a new discount program. Now members can get discounts at participating hotels, car rental services, theme parks, and cigar shops. These benefits come in addition to members-only cigar samplers and the satisfaction of joining the fight against harmful tobacco taxes and smoking bans. 2) The fate of a New Hampshire cigar tasting event lies in the hands of local politicians. For the past three years, CC&H Framing and Cigars has held an outdoor gathering in Keene. But some, including Councilor Philip M. Jones, want to outlaw the 2010 event, currently slated for August. “I just think it sends a bad message,” Jones told the Keene Sentinel. The City Council has the final say next Thursday.

3) Inside the Industry: Perdomo is lowering some of its blend’s prices, including the Lot 23 and Grand Cru. The new San Cristobal Papagayo XXL (5.75 x 60)—the largest of the line—is now available. Camacho Cigars is introducing its new Legendario Connecticut. CigarAuctioneer.com is auctioning off special signed boxes of Nicaraguan smokes (including the Padrón Family Reserve, Liga Privada No.9 Flying Pig, My Father No.3, and Oliva Serie V Torpedo) with the proceeds going to the Santa Lucia Home for The Elderly in Nicaragua.

Cohiba Behike1) The new Cohiba Behike is expected to hit non-U.S. stores in mid-June. Lauded by some as the finest cigar ever produced in Cuba or elsewhere, Behike uses a rare “medio tiempo” leaf and is being advertised as the “new standard among smokers worldwide.” Its name comes from the Tiano word for sorcerer or doctor. While the blend’s three sizes will retail for $36-57 apiece, high demand and low supply make black markets likely in countries where Cubans are legal—and almost certain in America thanks to the trade embargo.

2) The “CAO Invitational” golf tournament, sponsored by Famous Smoke Shop, will tee off Friday, April 16, at the Whitetail Golf Club in Bath, Pennsylvania. The cost of admission ($70 per person) includes greens fees, a post-round dinner, and a CAO goodie bag complete with smokes and swag.

3) Inside the Industry: All but two of the cigar rollers at the El Credito factory in Miami have been let go, Cigar Aficionado reports, as General Cigar transitions the famous space where La Gloria Cubana was created into a cigar lounge. The Cuban Stock Cigar Company is increasing its distribution of Exquisito, Chubbys, Cuban Stock Vintage, Joya de Havana, and Delicioso cigars to 130 stores nationwide.

Smoking Gun1) Government officials in Tacoma are trying to close down a local cigar lounge for code violations. Paul Mackay, owner of El Gaucho restaurant, has spent $15,000 on renovations to bring his lounge in compliance with Washington’s statewide smoking ban, effective since 2005. But this week the county health department ordered him to stub out the cigars because of violations: the lounge sells food and is open to the public. “Here we are trying to stay alive, and they keep dumping new rules, regulations, and taxes on us,” said Mackay.

2) Other Smoking Ban Alerts: UK doctors are urging politicians to ban smoking inside all cars. California lawmakers eye a statewide ban for parks and beaches. Michigan’s private clubs are lobbying for a ban exemption. Arizona State may criminalize tobacco on its  four campuses.

3) Inside the Industry: La Gloria Cubana is introducing a new cigar called Artesanos de Tabaqueros, which features a band at the bottom third of the cigar, a Connecticut wrapper below, and an Ecuadorian Sumatra wrapper above. Rocky Patel is introducing a new Decade Edición Limitada with a richer, spicier blend. Online retailer Thompson Cigars has sold off its non-tobacco retail operations, leaving the company to focus on its core cigar business.

Indiana IPCPR1) Indiana politicians have again rejected legislation that would have criminalized smoking in Hoosier State bars, restaurants, and other “public” places. “Our Indiana association members and their customers had a lot to do with defeating this proposed legislation,” said Chris McCalla, legislative director of the IPCPR. “They contacted their state representatives and senators in opposition to the bill because it was discriminatory, unnecessary, and it would have cost jobs and tax revenues. The General Assembly did the right thing at the right time for the state of Indiana and for that we are grateful. If the issue is raised again in the future, however, we will be ready once again to defend our rights and the rights of all the state’s citizens and help defeat any such bills.”

2) A network of “smoke-easies”—nightclubs that allow patrons to smoke illegally—have sprung up in New York City. The New York Times reports that Manhattan’s popular M2 UltraLounge is at risk of being the first establishment closed by the city government for smoking violations.

3) Inside the Industry: Tobacco giant Swedish Match, owner of General Cigar, entered into an agreement with the Plasencia Group yesterday to form Caribbean Cigar Holdings.  To promote the new Habana Serie R No. 3 size, La Gloria Cubana is giving away five trips to Las Vegas and a 2010 Lotus Elise sports car.
